II. As to Arrangements here discarded, namely under the
same notion as in the case of Institutions. These are
1. Arrangements by which excluding men Instance Exclusions from Office this or that Office on the score of ground of supposed inaptitude
in respect of age by reason of relative non-age immaturity. Instances
As in the French Legislature, all under forty years
of age.
2. Exclusion from Arrangements excluding men from this or that office, on the ground of supposed
inaptitude by reason of foreignership.
As in England, and it is supposed in most other
countries.
3. Latent Negative Instances in which a latent negative
in Legislature is given in the proceedings of the Legislature or of some branch
the exercise of this or that function belonging to of the Executive
department.
Instances of this sort may be seen in the Provisional Constitution
of Greece.
4. Arrangements by which a proportion to this or that amount greater than a
bare majority in a Legislative Assembly or Executive Council, are made requisite to the validity of this or
that act.
Instances of this are not unfrequent.
5. Arrangements by which in superfluous numbers greater than any
assignable can be found for men are compelled to assume
and execute burthensome functions.
Instance in English Judicial procedure, 48 men compelled
to be in constant attendance on certain juridical days, that
some twelve of them may serve in every cause or suit as Jurymen.
