§. 2. Functions of the Jury.
Art. 1. Of this Jury the functions are as follows
I. Auditive function
1. Antecedently to each decision pronounced by the Judge, to
receive 2. To have from him an explanatory statement explanation
of the state of the matter case in question; distinguishing between namely
1. The demand. defences and evidence on 2. and in case of defence, the defence. 3. This both sides, together with
the term of his proposed decision, and of the reasons on
which it considerations by which in form of reasons it has
been produced
1. The demand, with the grounds thereof in respect of law
and fact
2. Defence, if any, on both grounds
3. Evidence on both sides
4. Forms of Judge's proposed decision in the proposed terms.
5. Grounds of it in respect of law and fact
IV Commentative
II Art. 2. 1. To make thereon any such observations as they think
proper: whether indi individually, or collectively by the
mouth of the Foreman.
V> Opinative.
Art. 3. 2. To propose give the any such different decision as they
may respectively think deem proper: adding or not adding
the grounds of it.
Art. 4. To prevent confusion for want of practice on the part
of the Jurors, to the Advocates General it belongs, in case of
need, whether with or without being called upon, to interpose,
and lend their assistance to the securing an appropriate
form to any such proposed decision, Jury
as above, in particular the Pursuer General, in so far as
such proposed decision is favorable to the Pursuer's side, the
Defender General, in so far as it is favorable to the Defender's
side.
