§. Nugatory services
In regard to nugatory securities two topics require to
be touched upon:—
1. The securities themselves: 2. the circumstances by which
this quality is given to them.
Nugatory securities may be thus enumerated.
I. Antecedently to Office — II. During continuance in or say concomitant with Office: see Checks,
☞ Here they follow promiscuously: they will be arranged of course—
1. Promissory Oaths in general use—Concomitant.
2. Exclusionary declarations of opinion. Antecedent.
3. Exclusion on the ground of inaptitude, moral & intellectual,
where the inaptitude has no reference to the function:
or, 2, applies to the so few in comparison, as not to be
productive of any effect: criminals, insolvents, minors, aliens —,
interest witness in case of evidence.
4. Length of time determinate, provided presented as a security against
delay & precipitation, injudication or antecedent procedure
this in a case where no determinate length, can be sure of
being sufficient; at the same time that it is sure, in
many & even most cases, to be excessive,— needless
& mischievous.
5. Against abuse of power, multitude of the sharers. Effect,
Security none; but contrarily insecurity; Ill located
& exercised power strengthened by the multitude
of the sharers: and responsibility extinguished.
6. Number proportionally greater than a majority made
requisite.
