Article II. §. 2. ... "He" (the President) "shall nominate and by &
with the advice and consent of the the Senate shall
appoint Ambassadors, other public ministers and Consuls,
Judges of the Supreme Court, and all other officers of the United
States, whose appointments are not herein otherwise
provided for, and which shall be established by law. But
the Congress may, by law, vest the appointment of
such inferior officers as they think proper in the
President alone, in the Courts of Law, or in the
heads of departments."
3. The President shall have power to fill up
all vacancies that may happen during the
recess of the Senate, by granting commissions
which shall expire at the end of their next
Session."
7. 5. II. Heterogeneous power of the 2nd. Power of concurring
in the location in regard to the principal portion of
the aggregate of the Officers belonging to the Administrative
Departments, as herein above defined: understand
the to such portion alone of the Administrative
Department as belongs to the Union, that portion
which belongs respectively to the several States
themselves of the Union being in each State filled up
according to the particular Constitution of
that State.
The particulars as described in the Code are
these.
1. Ambassadors & other public Ministers & Consuls.
2. Judges of the Supreme Court.
3. All other officers of the United States whose
appointments are not herein otherwise provided for,
and which shall be established by law —
N.B. To this clause in the Article A list of these Officers would have
been no incongruous nor superfluous
