So much for the complication produced by the division
thus made in the Legislature.

To the mass of complications another addition is made
by the adding to the share given to the exeretitious body in the
Legislative Department, another share in the Executive

The more proper place for this part of the inquiry may perhaps
be in the Chapter on the Executive.

By the Constitution of the United States, Article II, § 2, clause 2,
to the President it belongs to "nominate, and by & with the advice &
consent of the Senate" to "appoint ambassadors, other public
ministers and Consuls, Judges of the Supreme Court, and
all other Officers of the United States, when appointments are
not herein otherwise provided for, and which shall be established
by law. Nominate he may all these several functionaries by
his own power appoint them— that is to say, locate them—
he cannot without the advice and consent of the Senate—
that is to say, a majority the whole number— to wit, 25.

Here then instead of lying with all its weight on
the shoulders of a single person, as under the here
proposed Constitution, all responsibility in respect of the
exercise of this most important and corruptive
branch of the Executive power is divided among twenty
five or in other words destroyed altogether.
