Here then to these eight-and-twenty person, no one of them
chosen by the body of the people, no one of them dislocable
but the people— is given the power of making internal
regulations to an unlimited extent or at any rate of involving
the confederacy in wars with any foreign powers in case
of the non-enactment of the laws stipulated to be enacted.
Here moreover is the power of selling the whole power
of the State to any foreign power or powers at pleasure.
This moreover with perfect and durably-established
impunity. For supposing the members of the Senate
in any number prosecuted and tried (not that any
such power is given) who is there by whom the
accusation would be tried? The criminals themselves— the
Senators: for no other power is there established for
the trial of such offences in any shape.
The accomplice too, the President, he also may be
impeached and tried? But by whom tried? —by these his
accomplices; for by no other persons according to this
constitution can he be tried.
Article II § 4. The president.........shall be removed
from office an impeachment for, and conviction of,
reason, bribery, or other high crimes and misdemeanors.
Art. I. §3. Clause 6. "The Senate shall have the sole
power to try all impeachments......When the President
of the United States is tried the Chief Justice shall
preside: and no person shall be convicted without the
concurrence of two thirds of the Members present."
