sometimes in a manner necessary, with intentions
or motive inconsistent with those.

He does not go so far as to swear, that the refusal was
not on account of the nuisance: and it
appears that in conversation he had alledged
this letter as the sole reason with some warmth.
Besides this the an Affidavit was of assurance an evidence
on his side, deposes that he has known the
House for upwards of 20 years to have a bad
character, & of late years but indifferent
no expressions more particular than this, are
employed nor any facts alledged.

Upon this the Court has no doubt but
tha the unwarrantable consideration was the
cause of the refusal, and the sole one.
Consequently that the fact that allegation that the bad
character of the house was the cause, was
not true.

refusing to renew the License of a Victualler
for an unwarrantable cause: viz. ostensibly the maintaining
of a nuisance upon the Highway
in his affidavit swears, that he refused because
the house was a house of ill bad fame.
It may be said however, that for the punishing
of a falshood of this kind there is no occasion:
for that so that the sensible facts
from whence the inference concerning the
intentions or motives are not concealed,
those intentions or motives will in truth
not never be concealed, allthough they be denied
by the party. If Where the exterior facts do not
of themselves form a sufficient conclusion,
in favour of the interior facts alledged, without
confession avowal, false allegation can not be punished:
& if where they do there is no necessity
for a true one.

The answer to this is, that the exterior
facts will often not be sufficient alone to
make out the interior; whereas an avowal
of the party on some former occasion, shall
do it clearly. Thus in the case alledged
it was the avowal of the Deft in the
manner mentioned that perhaps was necessary
to put it out of doubt. The length of time
during which this bad character was
supposed to have been continued, at the time
that the license was contravened notwithstanding
