Evidence
To ascertain, whether the in the instance case of evidence thus
circumstanced, whether the rejection collusion or the admission of it be the
preferable course, apply to it the leading cardinal fundamental question – Which
of the two results is the most probable upon the whole – the
that it shall be false and at the same time yet persuasive successful, or that it shall
be true?
The answer I think will hardly be that the instances in which the admission
result of it will be prejudicial to adverse to the ends justice oftener than it will be
will be more numerous than those in which it will be conducive.
Supposing it ti be pronounced in a general view admissible, the next question
will be under what conditions and restrictions?
