Under the English law, a man may arrest you every where you may arrest a man for a debt of
£10: and in some places for less. What he you must swear on this occasion is that he you
are indebted to him owes you to you to that amount: what you he need not swear, and
never does swear, is – that the without the security afforded by the
arrest, and consequent process of bailing, the vvalue in dispute
is in any danger in your hands. What he must swear is
that you are indebted to him in that sum what he need not
swear, and does not swear is – that he is not indebted to you
in an equal sum, or in a sum to a value any number of
times the amount of it. What is the The consequence is that the power
of arrest is in continual exercise in the character of an engine
of opposition: and where as between two adversaries the one of them having a claim to that amount upon the other it is not employed in that character,
it is to the probity or prudence of the party not to the wisdom or humanity of the
law or the probity of lawyers the profession that the justice suitor is indebted for the
forbearance.

If instead o a sum of £10 you have a property sun, a two
thousand times as great at stake upon the testimony of a witness probity of a third person
in the character of a witness, and the witness is bought by your
adversary, and by that adversary engaged to keep himself out have the country
to avoid of the way to avoid being called upon to come forward in the
character of a witness, he takes his arrangements at full leisure.
The power which in another the one case is given for so minute a cause, without any controul
from judicial cognizance the authority of the Judge to a every person who may be
prompted by country maker to abuse it, is not in the other case,
given though in a cause of the highest magnitude, allowed to be
exercised, under any emergency whatsoever, though even with the permission
of a the Judge.
