The confidence necessary to the bargain takes a different turn
in the two cases, according to the different aspect and position of benefit
by which the interest is crated. Where the release is from the witness to the
party, if the permission is received by the witness, before the giving exhibition of
his evidence, the confidence reposed is reposed by the party in the witness:
if not till after, by the witness party. Where the release
is from this party the witness, the no confidence at all is reposed by
the witness in the party, the only confidence reposed is by the party in
the witness. Such at least is the state of the case, or taking the bargain
and the transaction in its most natural and simple state: but for in
present the endeavour to augment augmenting to the utmost such mutual security as in a transaction
reprobated by law as well as public opinion, the anxiety and ingenuity
of the parties can may be able to devise, a bargain complicated there is no saying
to what degree may of course be employed pledges in hand, goods or money
by way of pledge mutual friends on either side or on both sides
rendering or professing to render themselves responsible – and so on without
end.
