Evidence
Such is the nature and efficiency of a release in the character
of a purge for carrying off mendacity: useless because needless and useless where
the disease does not exist: where the disease does exist, useless because
inefficacious. In general if it does no good, it does no
harm. Why? because in general, where the demand for the inter
evidence exists, the fact for the proof of which the evidence is wanted
is true, no disposition to mendacity exists, or what comes to the
same thing, none for against which the other securities for veracity – the
influence of the three sanctions political, moral, and religious – all bearing
on the same point all acting in the character of mendacity-restraining
motives – do not afford a sufficient antidote.
On the other hand in the case of mendacity on the other hand,
this sham security, far from being simply useless, is positively mischievous.
By producing an appearance of disinterestness consequent and trustworthiness
which in reality is wanting, the tendency of it is to
give birth to a misplaced confidence: to shut the eyes of the Judge
against that suspicion which upon grounded on experience reason attaches to would otherwise
attach upon human testimony the evidence, a suspicion proportioned
to the situation and character of the individual, and the relative magnitude
of the benefit at stake.
