Evidence
In a case of this sort to apply the want of the
defendt's testimony which by the supposition cannot
be brought to bear upon the case consistently
with the truth and expedt presents itself which
a certain degree may hear its case. The parting
by the supposition being opposed to each other face
to face in the presence of the Judge but would the
plaintiff hasv delivered his evidence but it is
just to the defendt, who by the supposition is upon
oath to say which what concern in one case he will not be
backward to say whether he does or does not
believe in his own mind that the testimony he
has been heard on the part of the plaintiff is
true or has its foundation in truth. A declaratn
to that effect on the part of the defendt to this effect
will move at the same time as a to false- falsehood
claim on the part of the plaintiff as also to
false defence on the part of the defendt. At present
under the current systems of procedure where the
parties are neither present nor upon oath or
denial with part of each of all allegations,
made on the part of the other takes plan
as a matter of course: sanctioned by constant traction,
+ instigated by his professional advisers, in whom the
