But in this remedy no such as it was, the interests of
the public as well as the interests of the individuals in the character
of plaintiffs were entirely neglected. The the rule which
exempted each defendant from being examined against himself to his own prejudice
was tacked on from the beginning a rule of like complexion which
exempted him from being examined to the prejudice of a;; his
accomplices of all persons that were involved in the same
charge. Why so? – because if all were guilty, the detection danger
was great – too great to be endorsed – that the guilt of detection of the
of the guilt of any one could guilt of one might lead to the detection of the guilt of another
–in short of all the rest, let the numbers of them be ever so
great. The consequence was that the examination of the
defendant against whom it were detected that no evidence should
be given being deferred till the whole of the evidence on the
plaintiff's side had been given through, since till then no
verdict could be given, the defend such defendant escaped
being examined, however pregnant productive his examination might
have been of detection to himself, and through his means
to the Co-defendants other his accomplices.+ + This opens a door to collusion likewise. But the plaintiff
