Procedure & Evidence.

It is in causes that are complex by multiplicity of
parties – demandants or defendants or both together – that
the mischievousness and absurdity of the exclusion on the single score
of interest and vexation and untrustworthiness on the double account of vexation and untrustworthiness are particularly
conspicuous.

If Let there be ten demandants and at the same time
ten defendants – all of them percipient witnesses with relation
to the transaction in dispute, not one of them can be
examined: – examined for or against any of the others –
any more than for or against himself.

Moreover Meantime, one observation alike obvious
and unimpeachable is – that the greater the number of
deposing witnesses the cause affords, whether veracious or mendacious veraciously or mendaciously
disposed
, the loss or the danger of deception from their
testimony: if veracious, the proposition is altogether out of dispute,
no man ever liable so much as professed a doubt of it:
if mendacious, the truth of it is not much less evident,
the chance being so much the greater in favour of the extraction
of those contradictions – whether self-contradictions
or contradictions ab extrà – by which mendacity is
exposed, and the truth of the case brought to light.+ + ☞ Insert this in the Chapter of Instructions.

Compare the exclusion in this case with the admission
in the case of the supposed plundered traveller, seeing the
district for satisfaction. In the one case all checks to
mendacity from counter-evidence necessarily wanting; and yet
the evidence excluded. In the other case checks to mendacity by
counter-evidence necessarily present: those checks multipliable indefinitely:
and in this case
the whole body of evidence
excluded.
