Evidence.

III. In To the third group come belong those expedients which in case
of a disposition to falshood either to incorrectness or to incompleatness and that disposition breaking operating out into
act (whether that disposition be or be not the result of any such
vitious will by which mendacity is produced) seeks to obviate
the effect of it by giving to the mass of testimony those properties
that correctness and compleatness in respect of which in consequence of such that
disposition it might otherwise be deprived. If it be from the
store of facts in possession of the same deponent that the deficiency
is supplied endeavoured to be supplied, interrogation is the operation instrument by
which the service is done performed: if from any other source, the
operation comes under the head of admission of counter-evidence.

IV. In To the forth group come belong those expedients in the
application of which it may be necessary for the legislator to take the legislator takes an active part in
respect of the discovery of persons and things capable
of serving in the character of sources of evidence,
and in the giving permanence to whatever evidence happens
already to have been delivered. In this group the first article
consists in the creation of the powers, the legal powers
requisite for the investigation of testimonial or other evidence: of out one
source of evidence though the medium of another. The other
article consists in the applying to the desired purpose the art of
writing, printing of course intended) the only adequate and generally applicable principle source means of
permanence. If at a time when in the character of a ground
for decision, the demand for a lot mass of testimony presents itself, it is no
longer to be found, it might as well, or perhaps better, never
had existence.
