II 429 Simple restrictive punishments –
Nothing then has been punishments
Nothing can In penal legislation no
punishment has been devised so injurious as
that of presence-banishment. This
punishment found in the old french law,
of trace may be found in the
Danish Code, may, with some improvements,
offer an admirable resource against the effects
of individual enmities, from the which the
public in general has nothing to apprehend
This punishment provides a triumph for
the oppressed against the oppressor, and restores
with the greatest possible mildness the equilibrium
of between injured innocence and overbearing violence
It moreover prevents the renewal of quarrels
and deprives the aggressor of the power of doing
further injury. But to make use of an
expedient that in by which reputation may
be so materially affected, requires the most
scrupulous attention to be paid to the respective
situation of the persons concerned.
