In opposition shall I say, or in affirmation of more or less decided, more or less clear, to Against the notion of the corruptive tendency of money when
finding its way into the hand of a Judge in the shape of fees, the
Judge by producing as often as he produces so much delay, expence and vexaton getting
so much money which without producing the delay, vexation and expence
he would not get, I find a very high great authority: no less than that
of the celebrated Committee on Finance of 1797 and 1798.

Of these fees (it is said) that they mention is made as
"affording a mode of supporting it" [the establishment] which may be "oeconomical

to the public and not prejudicial to the Suitors, in
"every case where a precise rate if fixed, moderate in its amount
"duly proportioned to the particular service."

"and more especially where wherever circumstances will allow of the
"aggregate amount being carried over to a common fund for the
"general support of the whole establishment."

Immediately before fees had just been (it had just been said)
"are to be considered so many direct taxes levied upon the King's subjects
"for the specific purpose of defraying the charge of those offices to
which they are incident, and levied generally upon those persons to
whom the particular establishment renders the most direct service.

The most direct service, yes: a careful and correct distinction
the greatest service, no: chance for it be but a chance of the receiving of that remedy which in return for wrong sustained that security of which at the end of
a course of delay, expence delay, expence and vexation a man receives the whole law
holds out a promise
a chance and but a chance, is a more direct service than that
which every man reaps who in virtue of the security protection with
which he is every moment covered, experiences receives neither wrong nor
remedy.
