Ch. 9 Evidence

As to the part address to repugrants, it is – If
your adversary is not in such or such by whom a right
is claimed to your charge – a right the effect of which
were it invested with it, would be to subject you to such
or such an obligation – is not possessed of a title to such
right, he shall not be invested with it – you shall
not be subjected to the corresponding obligation. – Another
instance of a prediction of the collateral and negative kind.

In the case of a law belonging to the penal
branch, if it be among the cases for in which satisfaction, over and
above that which is inseparably attached to and virtually included
in punishment, is administered, a law of the non-penal
class is attached to the law of the penal class; the
right to receive such satisfaction is a right with which the injured
party claims to be invested.

In the case of a penal law, the a party interested
in the fulfilment of the prediction meaning the direct and positive
prediction is, at any rate, the community at large, in
respect of the check which it is the object of the law to
oppose apply to delinquency – and thereby to that mischief the promotion of which it
is or at last ought to be the object and final cause
of the law by which the quality of an offence delinquency is conferred
on the obnoxious act.

If, or to this penal law, a law investing the
party specially injured with a right to receive satisfaction
is attached, another party interested is – in respect of
such title to satisfaction, the party there specially injured.
