Ch. Of Defence – juridical defence.

We have seen how simple the idea general conception of demand is – of demand
with its that of inseparable concomitant – its correspondent supporting
title.

The idea of defence is not quite so simple. It includes
the idea of demand, and it includes in addition to that idea it includes some other.

Do you admitt the allegation of the demandant, law
and fact together? If yes, there are as under de is no defence
in the case: the Judge has what the obligation that falls upon the
Judge of course is that of rendering the service: rendering to the plaintiff the demanded service.

If no, the law not being contested, what then? far
In point of fact, the defendant may always see lying before him
if truth be o his side, two ways of sorts of opposing answers applicable to contesting the plaintiff's title.
One is by denying the plaintiff's fact: viz. the existence of the
Invectitious or collative hand: the other is by asserting a fact of
an opposite tendency: the existence of some want, having, on operating upon
the plaintiff's right in the character of a devestative or ablative
event.
