Evidence

Upon the face even of this general statement, the latter proposition
has surely some claim to confidence. But The more closely the
question is grappled with, the more compleat decided and unreserved will
be our confidence. For the The proposition howsoever true in all its
amplitude, is much more ample than for the present purpose
it has any need to be.

Suppose the rule opposed to the proposition to which the proposition applies a negative
established: consider what the vexation is that would be saved
by it.

This vexation is immediately seen to be resolvable resolve itself into
two perfectly distinct and widely different masses: 1. In the
case where in consequence of the exclusion the law (the substantive
law in question) fails of being executed, the vexation that would
have been produced by the execution, i.e. the vexation
of which the punishment is composed in cases purely penal,
and the vexation produced by the obligation of rendering the satisfaction
adjudged, in other cases. 2. In the case where, notwithstanding
the exclusion of the particular obnoxious lot of evidence objected
to on this ground, the law receives its execution in virtue
of some other evidence, the difference, if any, in respect of the quantity of vexation
produced between this that would have been produced
by the delivery of that obnoxious evidence, and the quantity actually produced
by the delivery of other the other unobnoxious evidence.
