3. Irr Irreparable corporal injuries: those which produce
a permanent effect upon the body such as
marks mutilations &c.
4. Ignominious punishments the object of which
is to expose the delinquent to the contempt of
the spectators, & to cause him to be regarded
as unworth y of assoc to special associatg
with his former connections.
5. Penitentialy punishment though designed to awaken
a feeling of shame, & to produce a certain degree expose the object of them to
of censure blame, they are not of that degree of
intensity or publicity which produces infamy
or that can cause the delinquent to be regarded
as unworthy of being again admitted amongst
his former connections. They are in fact
such punishments as a father inflicts upon
his children, and which the most indulgent
father would have no scruple in inflicting
on his favourite child.
6. Chronical punishments: they are rigorous their
rigour consists in the length of their duration,
so much so that they would not operate as
punishments were it not for this circumstance.
Expatriation Imprisonment &c may be
perpetual or temporal.
7. Simple restrictive punishments: those which, though
not possessing any thing in common with the
preceding class, consist in a certain degree of
confinement or restraint, in preventing a man
from doing that which he deserves to do: for
example the forbidding a man to ever a
particular profession to frequent a particular place.
8. Simple compulsory punishments: those wh that
oblige a man to do a thing that he desires
to avoid the doing: for example an obligation
at particular periods before a judicial officer.
The punishment does not consist in the
of effecting by which the object is effected but in the inconvenience
resulting from the restraint.
