Evidence

It appears then that the practice of motions, is is has been
in both its branches, but more in one as to a great part
in the other purely and simply altogether, a conspiracy among lawyers – among
lawyers of all classes by descriptions on false pretences to extort money from
the suitors.

A conspiracy? – No: not at any rate at least in the legal technical sense:
for a conspiracy in the legal sense is a punishable offence.
A conspiracy succeeds or fails may fail succeed or not succeed: this contrivance never does or can
fail: conspirators are exposed to punishment: their confederates associates
so far from being subject exposed to the rod, are themselves the masters
of it. Depredation exercised is out of the reach of punishment:
escape from them is hopeless: resistance criminal. But
in what respect is depredation the less mischievous for being out of
the reach of punishment.
