In the present instance case as in every other the effect will have had
its cause: what is here where shall we find that cause? In the nature of man and
government.

Applied to this branch of the law, as to any other, legislation
is a branch of government. Government, a work of mans
will like any other works of man have had the predominant
interest of the agent workman, so far as opportunity favoured adequate power and intelligence were present, for its
final cause.

This aetiology will not be found in any page of
or Coke, or Blackstone: but it will be found in every man's the observation
and experience of every man who has sense to preserve
it and honesty to confess it: a different the opposite one would not mind
the matter but make it worse, beyond course.

In this branch of government as in every other, especially
in those early days rude ages when depredation and oppression paraded stalked forth without
a mask, and shame was a sensation sense scarce known to
power, the personal advantage of the workman would be it
were too little to say the principal object, the only object thought of
in the work. Here then we have the end actually pursued,
an end different from the legitimate end, a false anda particular, a personal, a spurious
end: Of by an and set up by particular and private interest.
If by any accident the path leading to the attainment of this
spurious end happened to coincide in any part of it with the
path leading to the attainment of the legitimate end, in so far
the legitimate end would be pursued, and adequate power and intelligence being all along supposed not deficient
attached. If in any part of it this by path happened to lead run
in a direction opposite to that of the great public road, the public interest
would on every such occasion be sacrificed the legitimate end in its several
branches, not attained but contravened.
