Evidence
Though the existing systems, at least so far as the tenor of them has
depended upon the exertions industry of professional lawyers have all of them originated
in the pursuit of the sinister ends, and been directed to the
fulfilment of those ends we are not to regard them in that account
as uniformly and in any part adverse to the legitimate ends of
justice procedure – the ends of justice.
Throughout their course Their misdirections course has in a greater or less degree been interrupted, their
mischievous character and tendency softened by two antagonizing causes.
1. The necessity of appearing being thought to consult those public ends keeping
as much as possible their sinister ends and sinister operations from
being discovered by the people whose interests they were sacrificing
to theirs – and thence the necessity of fulfilling to a certain degree
the ends of justice.
2. The interpreation of the legislative authority – of the controverting
and correcting hand of the legislator, interposing for the benefit
of the people, and removing more or less of the mountain of
abuse and injustice which the fraternity of professional lawyers were so
constantly employed in rearing raising up in the pursuit of their those their own
sinister ends.
