Evidence Introd.

The arrangement which when a man has purchased a share in the
profits of a manufacturing concern for what he thinks a limited sum,
forces the whole of his property into the adventure without his knowledge,
– the arrangement which on the ground of a secret act, affording no
presumption of insolvency, vacates all subsequent contracts transactions of the same
person, and divides dividing the property of one set of men among another
of whom they had no knowledge. The commission relates
back – relates back to the time when the secret act of bankruptcy, the unknown secret
trade of evidence if insolvency, counter evidenced and disproved by years of solvency, was committed.
In the abuse of these
two words relates back,
an abuse which no
man to whom justice
had been odious
would have committed
consists the pretence for
the opening and keeping
open that inexhaustible
source of affection, ruin and
injustice.

To prevent every thing of surprize and disappointment – to prevent
every thing that productive of revolutions on property, is the object of
the legislator in proportion as his heart is warmed and his judgment
enlightened by the love of justice. To produce organize a perpetual
manufactory of surprize and disappointment – to set a going a perpetually-revolving
series of revolutions, was among the objects and delights of the
Englsh Judge: to keep up in a state of delectable as well as profitable
agitation an ocean a sea of troubled waters in which the Leviathan of the time might find at all times in constant abundance not only food and
sport. Short sighted misguided Englishmen! to look to France
with its Jacobinism for principles of confusion and insincerity! look up, and if
prejudice has not blinded you, you may behold them seated in
the benches those high places on which your fate depends. Every
technical reason, every exemplification of that absurdity or that
wickedness which in the language of English technicalists is varnished
over by the name of astutia, is so much established Jacobinism established.
Jacobinism not in theory but in practice.
