Evidence Introd.

Here then have been a set of men, acting all along with
full powers, acting without interruption, under the impulse
of an interest, acting pointing in direct opposite to the interest of the
community people: acting without any constant controul but that of a
body of men (I speak of the Parliament) a single superior,
I speak of their Creator the King, acting under the impulse
of an interest in league with theirs, and without any occasional
controul of a body of men I speak of Parliament,
appointed only by accident, pre-occupied with more
pressing interests, depending for their capacity of action upon
the necessities of the King, in no one day of their
ever seeing another, disabled from exercising any steady
and sufficient controul by disabilities negative qualities of all sorts, by want
of individual interest, by indolence, by impotency, by ignorance:
by fear of the vengeance that might overtake
those whom by depilation of and separation divested stript
of their brief authority.

Thus it is that judging to judge from general principles –
principles received, and even by the authorities of the
day received and noted upon in a large scale, the texture
of English Law procedure should be as bad, as adverse to the ends, the acknowledged ends
of justice, as English popular patience, inculcated by professional artifice, supported by English ignorance
and prejudice could have suffered it to be. Such
upon general principles, is the conception, the expectation that ought rationally
be formed of it: – and the more closely it is looked out⊞ ⊞ by whoever has and strength of eye to view it look at it in this light the more compleatly and incontestably will that expectation be confirmed.
