Case the 3d stands upon a ground nearly the same as Case the 2d: with
only no other difference that what, according to the nature and importance
of the cause is likely to have place between the degrees of interest
respectively taken by a party, and a third person.

In English law this case is realized as non-penal 1. in the
answers extracted in writing from Defendants in the Equity Courts to the
strings of questions propounded in strings by the instruments called Bills:
A Bill in Equity consists of two parts: a narrative part narration which being
exhibited not upon oath but made at random by a man who by his own shewing us uninformed knows little or
nothing about the matter
of what he takes upon him to assert, is not made use of in the cause
as evidence: and an interrogative part, in which are contained,
in a simultaneous series the whole number of the questions to which
the Defendant is called upon to make answer furnish answers.
