Evidence
On every occasion on which a demand (synonym) is made presented by a
man in the character of plaintiff (synonym) to a man in the character
of a Judge, a service is applied prayed for at the hands of the
Judge. But a service of a legal nature can scarce be rendered to a Judge
without risking in the shape of a burthen upon some other
man party individual or assemblage of individuals, who in respect
of the faculty allowed him of deprecating the rendering his subjector
imposition of such burthen is stiled defendant.
Such as the shape is in which this service is rendered, such
is the nature of the demand.
1. Servitium : the sort of service which is rendered
to the plaintiff by the imposition of a burthen the
score of punishment, on the defendant. Servitium .
2. Servitium debitum <add>injurious</add>. The sort of service
rendered to the plaintiff when having by the act default of the defendant
sustained an injury of any kind, he receives a benefit
in some shape or other at the charge of the defendant in satisfaction
for the suffering to which that injury had given birth.

3. Servitium Collatis dominia generalis . The
sort of service rendered to the plff by investing him with the general
property or dominion of a specific thing belonging to the category of
things moveable: viz: that sort of property which a man has in
the thing when he is entitled to treat it as his own. Collatis
dominia generalis .
[ ] N.B. No mans property in any thing can be called plenary, if
by plenary be understood exempt from all limitation: of the truth of this position
the well known rule of universal justice sui will afford the exemplification.
