Evidence
(a) [Ulterior suffering] Satisfaction suffering
Of the ends of judicature, were there none of them
but what were capable of being presented in a positive
or affirmative shape, the description list might be very short.
I. In case of wrong, supposed to have already been
committed – Application of the matter of satisfaction where due – and in
the shape in which it is due.
2. Where without is as on the score of punishment
ulterior suffering(a) is supposed necessary, application of
such suffering when due, and in the shape in which it
is due.
II. – in the case where no wrong is supposed to have
been committed, but, at the hands of the Judge that a service
which consisting generally in the conferring of some new right(b)
in the plaintiff or demandant(b) is demanded –
3. Reddition of judicial service (generally by Collation of right) where due, and in the shape in
which it is due.
4. Reddition of judicial service at large(c), where
due, and in the shape in which it is due.
