2. Next cause under review
From In the uncertainty on which side it this purely physical sanction will operate
in with greatest force, and from or in the comparative weakness
with which it operates with a preponderant force in
favour of correctness and compleatness, may be seen the
demand which has place for the operation of the several
rationally operating sanctions in the character of securities other sanctions that have just been mentioned: sanctions
for those qualities in which the more it depends on
their testimony shall be subservient or adverse to the interest
of justice, in the the sanctions in the operations
of which the judicial faculty is made to bear a part
to which in contradistinction to it may be given the common denomination
of rationally-operating ones, in as much as in
the operation of their respective operations the reason –
the judicial faculty – can not but be have been made to
bear a part.
