§ 7. IV IV. Counter-evidence: –admission given to counter it.

Evidence In relation to any supposed matter of fact fact, evidence being delivered on one side of a cause,
counter evidence is any evidence delivered in relation
to the same supposed matter of fact on the other side:
in any other side or: if more parties than two with
conflicting interests, on any other side.
Besides the influence exercised by counter evidence
when delivered, the expectation of it operates will naturally operate
with more or less force, through the medium of fear of punishment and shame, as a security against vices deceptions
thence against that
against temerarious as well as mendacious statement,
understanding on the other side thence against mendacity
and deceptions incorrectness and incompleteness on
the other side.
Note, that as Cases often as, to any article of evidence, the
name and effect of conclusive – as in any the phrase conclusive evidence –
is l attributable given, an exclusion is thereby put in the lump, upon
all counter-evidence not already received, and upon the effect of all
other counter-evidence purpose received or not received. With what propriety
