Evidence
In proce judicial procedure, everything having for
its author the man of law, everything on this s on other occasions, under favour
of the darkness of the age, had everywhere of course, for either for its chief
of if not chief or for not to say its sole chief object, in as far as circumstances admitted, the convenience – the advantage
in every shape – of the man of law.
To this cause refer without in the difficulty those so many pernicious
principle applications as in this field may be seen made of the principle of the division
of labour; – that general principle, which in another
field of such riskis productive and salutary
of which is, in the field of political economy, so salutary.
Beneat Beneath as well as on the bench in each offset
each into which, by division, the depredator polyps
polyps the polyps not to say the leach has contrived to multiply himself, behold at the same
time a screen, by which the light of true information the
light of evidence is shut out and a a disturbing colouring glass
discolouring medicine by which false light is let in, as well as a spring and a direct spring,
by which the substance of the and about litigant is
absorbed.
The Judge divides himself has divided decomposed decomposing himself into the evidence-collecting
and the deciding Judge: the professional agent of the party into the
attorney and the advocate: each of those again into another task of cluster of
subdivisions sub-offsets, the more numerous the more favourable to
misrepresentation, to its consequence misdecision, to the
boundless encrease of factitious and useless needless delay,
vexation and expence.
