7. In the close Rome-bred mode, the case where, as above,
the the individual on whom the operation of extinction by interrogation is performed be if a
subject an individual is examined – not in the character
of a party litigant but in that of an extraneous
witness, the questions, being which the examining

and degree of distinc separateness and distinctness has
by this means, been in that instance, been given to the answers responses, of
which the mass of evidence extracted, from each such examinee
is composed: – some sort of preservative, more or
less efficient, against confusion, designed or undesigned.
In the case of the mass of evidence, delivered in the
and by the affidavit of each deponent, the use of the same principle
of distinctness, or at least of distinguishableness, might
be and rendered applicable employed with equal case. But,
