2. As to utility – of a review of this sort, the utility
if any it have, will show itself in the one or the other of
two opposite ways: – 1. if the matter of fact in question
be real true, in causing, or contributing to cause it,
to be believed: – if not true, in preventing, or contributing
to prevent it, from believe believed.
In both ways, the subject has presented itself as
being open to observations, capable of being contributory to productive of
conducive to the desirable effect.
1. In the case where the matter of fact is true, principal
of instances will be f brought to view adduced of facts in the character of principal
facts, having belonging to this of to which will respectively be found applicable evidentiary
facts, in classes of such except as range that so ample in extent, and of which
the probative force seems to have undergone been subjected to so little
scrutiny, that any observation from by which to those to whom
it belongs, any assistance would assistance facility may be afforded, for
towards the making a correct estimate of it, could can
but scarcely be ill bestowed.
In some of those instances, circumstantial evidence
of the most instructive kind nature has been found
enveloped involved in that system of exclusion, of which
the folly, and rashness, and iniquity will be held up to view: and
if, in those instances, as in so many others, the system
should the exclusion should be found unwarrantable indefensible,
the more important and instructive the lights this of which
dealt with justice is deprived thus deprived nor seen to be, the better the chance
stronger the ground, that will thus be have been made, for a amendment
in this line.
