Evidence

The On this occasion, the series of actions, by which the most adequate impressive,
as well as important illustration may (It should seem) be afforded,
of this head department of circumstantial evidence is that of which
the course of pro judicial procedure is composed.

Let the consequent in question be the last or among the last, of the constantly recurring
articles if such there be, in such a series.(a)
Note 3(a)
(a) the judgment Consequent for example,
in Common-Law language served the judgment; in
Equity-Law language, – the decree: – the antecedent, (the first
or among the first) – the Declaration writ or the in Common-Law
language, the Writ or the Declaration;the Bill in Equity-Law language,
the Bill.

Text resumed –
In these cases either of these cases, the probative force with which
the existence of the contendent, in the character of the
principal fact, is probabilized by that of the consequent,
in the character of an evidentiary fact, will, appear
present itself
to an eye, the in any the slightest degree
conversant with the course of legal procedure, be apt to present
itself to a considerable extent as little less strong than that with which the
existence of past infancy is probabilized by present
old age.

But, as from one place to another there are frequently
different roads, so also between the first and the last stage
of a course of judicial procedure. And from this by this circumstance, (it is
circumstance its easy to see) that the degree of probative force, with which a naturally the existence of an
naturally ordinarily antecedent fact is probabilized by the existence
of a naturally an ordinarily consequently fact, will be liable to be
in a greater or less degree diminished, according to the
nature of the case.
