CERTAINTY SUMMARY. PROCEDURE Oeconomice - penal Staff.

To reduce them into an uniform System
1 The Jurisdiction to be regulated by the quantum of the Penalty

2 If x, before [a 2 single] Justices without Appeal with power of Challenging & other precautions
specified in the title Trial before Justices" for small Larcenies & Misdemeanors, to which may be added
here as well as there an express permission to the accused to bring a certain number of persons
to be present

3 If x+y as before with power of Appeal to Quarter Sessions - there final

4 If x+y+z - at Quarter Sessions with power of Certiorari & Appeal to B'-k.

5 Application of Penalty uniform in all - as for instance 1/2 to the Informer 1/2 to the King.
Certificates with the King's share of the Penaltyies to be transmitted by the Justices both from
Petty & Quarter Sessions to the Judges at the Assizes who to transmitt them to the Master of the
Crown Office for him to keep a Register of them

6 By this Register the total amount of Monies recover'd in this way for every year will
appear, from whence which intelligence may be applied to various purposes of practise & speculation
The comparative frequency of the different transgressions will be represented. — In Revenue
Laws, the comparative frequency of transgression & detection (the quantum of transgression being computed
from the difference of between consumption and what pays duty.

7 Minutes of the Convictions at the Assizes & Sittings enter'd in that same Register & the Penalties
carried to the same fund.

8 Specified Forfeitures [if admitted of] to be sold the next Market day at the next Market-Town — money
applyd in the same way as the pecuniary Forfeitures.
