CERTAINTY of PUNISHMENT
The regular and distinct form I have endevored to give it, is not meant as an exact picture of it, but made such merely for the sake of the reader's entering into the conception of it with greater facility
These examples are to be taken not merely
from the Law in question but from the
whole System - the examples that come under a single
Law are can not hardly be sufficient to form
a probability.
In more familiar language — Let us
suppose that every transgression of every
Law of the System in question had been
punished by the penalty without exception to the present
hour — it is evident that the certainty
of punishment to a person who should
now have a crime in contemplation to committ a crime
would be entire — if thate puni misery <add>pain</add> of that
punishment were instant and greater than
the pleasure of committing the crime he could not
possibly committ it: he would no more
committ it than men run thrust their hands
into a fire when they are cold.
Obj. Men copulating with a subject known to be infected - Answ. All the Crimes but that of Rape further removed from
[an example exactly parallel,] nor than a man
who knows not how to swim cannot write will runs into a deep
River to cool himself. To bring the Punishment
& the obnoxious act to the same intensity of connection
should therefore be the object of the Legislator. In exact
(portion as they approach to it is the efficacious
so for instance but 100 against 100 would only make an even chance.
