It is scarce necessary to observe, that this Alt:y

but oppression.

He the prosecutor chose to have punish any of the
Defendant once to what amount he thought proper
against the opinion of the Judge by way of introduction to the Judge's punishing
him once more with such a punishment as
was competent to the Crime

Such & such only can be the motive of
any one who shall exercise the privilege it in future
if it is not meant to be meant it should not be exercised, there
is but one way to be sure of it, & that is to
take it away.
