Certainty Phn.Procedure Summary Distress

4th.c.24.5 [Dying Woolen improperly] 20 days' time
is given for payment between conviction & distress. -
Might not a certain interval be always allowed
for instance 4 or 8 days except where the Proscutor Performer
will swear that he believes the convict will remove
his goods within the time? And the same interval
to be allowed for Appeal & entreaty into
the proper recognizance either before the Justice
or some other - whereof notice to be delivered under
the hand by Seal of such other
The Justice at the time of conviction to offer declare
the term of the imprisonment to be suffe'r'd in default of
distress; & if the whole distress a part of the harm forfeited is levied
and not the whole, the what is levied to be should disposed
of in the same manner as the whole ought to be
& the imprisonment to be shorten'd abated per tants proportionably.
If nothing less than the whole Penalty is taken, given Informers
will not inform against delinquents where they think
not able to pay the whole; for the imprisonment is but
a forlorn hope, & can never rather to be their original dependance.
