CERTAINTY. SCALE of AUTHORITIES.
QuShouldAccording this Scheme Plan which I have ventured to propose
for the fixation of the Criminal Law be accepted,
& if upon experience found to answer its design,
the general determinations of Law being would
therein be anticipated, and determinations concerning
fact are particular and admitt not of
the application of Authorities — The use of what are called Authorities
would thus be suspended, & consequently the
necessity of treating of their Estimation: But as
by far the greatest part of Jurisprudence, namely
the Civil, is not incapable under a long time if
ever of being reduced to that pattern of simplicity:
& if it were otherwise, the very disproportionate probability
against the adoption of this, or any other any Plan supposing it even
meritorious, which threatens the Service with so extensive
a Revolution.

which a man Nor is that better or
should preserve in the
love of his country
condemning the sullenness
of refusing to
serve it, because he
cannot serve it privately
and his own way.
