CERTAINTY OBSTACLES TO - Division of

Obstacles to the Certainty of Execution are 1 Previous
to Arrest Apprehension 2 Subsequent

Previous to Arrest are [Nonappearance which happens from] 1 Concealment 2 Flight.
3. Asylum 4. Reluctance to prosecute.

Subsequent to Arrest are 1. Escape. 2. Acquittal
from matter of Fact (wherein of Evidence) 3
Acquittal from matter of Law. 4. Pardon.

The direct end of the Adjective System is rather the
Bringing Punishment to bear upon the gravity than the
saving of the innocent from it, which however important
is only properly speaking but a collective one: for if this were the
powerful one, the sure way of attaining it would
be to inflict not to establish any thing as Punishment -

The precautions for this latter purpose come in
as it were incidentally in the character of Provisos
to those calculated for the other which are the
main principal regulations.

'Tis therefore hence that it become unnecessary to allott
to those provisions the consideration of a distinct kind of their own.
