CERTAINTY. ACQUITTAL from LAW. Previous Settlement
by Judges.

It was not formerly not uncustomary in individual cases matters
of nicety and difficulty for the Judges to meet
and settle matters of Form before hand

An instance of this is mentioned occurs in Coke's 3rd Institute
p. 110 - where such a consultation is mentioned
to have been holden on the subject of a man who
had stolen grave-cloths - the doubt was whose
property they should be charged to be : were and it was
agreed it should be that they were that of the Exer or Admsr. + + Ld. Coke goes on to say 1 or other owner but this must certainly be a mistake: for this much may be believed of Judges of those times, yet one can hardly suppose that there reverend persons persons could lay their 12 hands together to for the any purpose than that of resolving of sanctuary to a resolution that the property of a thing is in the owners
of the deceased: and such they should be charged to
be in the Indictment.

Another is that of the Trial of the Regicides: the
whole proceedings in which were conducted according
to the previous resolution of the Judges. || || v. rep.

There is an apparent unpropriety (& it is but apparent )
in this practise of the Judges lending their assistance in this
manner to the prosecution - but the benefit of it is
real.
