Tit II. Art. 1. There shall be in each Canton a Justice of the Judge of the Peace,
with Title in art. 1. Observations [Prud-hominis] Good-men-and-true
for his Assessors.
Observations on Tit. II. art. 1.
The provision in this article grounds itself on the pro
author's proposed subdivision of the Departments into
Cantons or Sub-sub-divisions, a provision which
as applied to the business of electing electors to the
National Assembly Legislature was rejected by the National Assembly.
1 Canton judications — objections to The objections I have to make to this articles are as
follows
1. That the a new division into Cantons of equal dimensions
is not so convenient as one grow which I
have proposed, taking which takes for its basis the
old-subsisting division into Parishes. For
1. You can not be sure It is not every canton that
could afford to defray the expence of a Judge appointed
2. Though the dimensions of a Canton will in general
be so much bigger than those of a parish, you
can not in every Canton be sure of finding a man
of education already fixed to the spot, as in every
Parish you may in the person of the Ecclesiastical
Minister.
2. That if in any Canton more business should
arise than it is possible for any one Court to despatch
no provision is made for possibility is provided making any addition to the
number. In my plan ample provision is made for
this contingency by the powers given to the le subordinate
legislative assemblies of appointing additional Judges to the Parochial
