3. The like observation relative to the provision requisite
for the case where the Judge is disabled for a time
by sickness or any other impediment from attending discharging
the functions to the duties of his office.
4. That the institution of Assessors to the Judge under by
the description of Prud-hominis or Good-men-and-true
is not well adapted to the purpose. See this
matter discussed under the articles Tit. III. art. 5, 6,
7 & 12 in which the qualities, functions and mode
of election of these Assessors are laid down.
Nomenclature 5. As to the official denomination, why Justice Judge of the
Peace. Have the other Courts to which this appellation
is not attributed less concern in keeping the peace than
these? Is there any Court that contributes to render justice
without contributing to keep peace? The appellation
seems borrowed from that of our English Justice of
the Peace; but examine look into the functions attached to the respective offices,
nothing can be slighter than the resemblance.
