denomination is uniform as the series itself is. In the
series District-Court, Department-Court, Superior
Court, and Supreme Court of Revision the uniformity
is departed from and a perplexing diversity introduced.
A tacit reference to the old system may have
been at the bottom of this imperfection as well as
of others. When instituting his Superior Courts, our
legislator probably thought of the abolished Parliaments
known also by that title. In establishing
his Supreme Court he plainly thought tells us himself of his having evidently had before
his eyes a Court of the King's nomination,
(the Conseil des parties) ++ p. 3. the business of which was to serve as a controul
over the Parliaments which were falsely termed
Sovereign Courts, and Royal Courts without being
either the one or the other.
Why is the one sort of Court to be stiled a Court
of Justice, and the other a Court of Revision? as if
justice was not administered in the latter, nor matter judgments were not given accor received in the one, nor given according
judgment to justice in the other. Difficulty of apprehension,
cross indistinct indistinctness of perception and precarious
retention are the results but too natural of such anomality.
