High Court before this High-Commission Court sitting no
doubt at Pari in the metropolis will would have the effect
of dragging men to Paris guilty or not guilty from the most distant
Provinces, and depriving them of the right of appeal.
What would you have a Chancellor then or a
first Minister of Finance triable before the Judge
of the Parish where he lives? — Why not? where
would be the possible inconvenience? I should not
indeed much expect to see him tried there: but
on my plan he could not be tried there unless
the Judge chose to try him nor unless Defendant
Prosecutor, Judge of the District Court above and
Pursuer General of that Court concurred in the
same choice.
If both all parties are satisfied with the judgment,
where is the harm: it is the very thing we wish
for: if any one of them be dissatisfied with it,
it is not conclusive: he appeals: and so on till
the cause gets t up to the Supreme Judge, and
if necessary to the National Assembly.
But the great security against mal-practice
misbehaviour in such cases is not the quality of
the Judge, but the quality and multitude of the
bystanders: such a trial & of such a person would not
want for bystanders, and those distinguished ones.
Under the Committee's plan, tak beating down
as it does all tribunals of exception would not a man
