Determinations may be expressed as intelligibly by conduct as by words. But suppose
the High Court of Justice to say to all other its
Courts of Justice to all its subordinates throughout
the Kindgom, if you dare presume to execute this or
that degree decree of the National Assembly we will
turn you out as by law the Assembly itself we are authorised to
do: — where would be the remedy? The High
Court it will be said in answer is not to be a permanent
one: it they will not have existence till
somebody by the act of convocation gives it them:
the National Assembly a may be that somebody.
If this be the case it can make no such proclamation:
it can not punish any body for
executing the Decrees of the National Assembly:
but what it can do and may do with impunity
is refusing to punish any body for
not executing the Decrees of the National Assembly
refusing to do the only thing which in
the exercise of this branch of its authority, for
it is to have others, it is created for. But
if it does so once upon and that principle, it will [+] [+] for the same reason do so
again and again, till it has given a full license for
