object is the prevention of litigation. How are they
to pronounce? upon no grounds at all? hearing
neither evidence nor argument? But offering either
evidence or argument is litigation. A law-suit
carried extraordinary appointed in order to prevent
litigation! Litigation prevented by the carrying stirring up
in raising a of a law-suit more than there would have
been otherwise. It is wonderful how such a
deceit like this could have palmed itself upon
such so many sagacious minds.
The proceedings then before a Board thus
named must in the nature of things be subjected to have all
the inconveniences of [those before an acknowledged
Board of Justice] litigation. The institution of
