people are a bad set of people: but the Plaintiff is

relief in England by taxes and in France by Peace
and Reconciliation-Offices.
This is not all. The inventors of this humane
but ill-judged expedient have more colour of reason
than this, though it is but colour, on their side.
Under the wretched systems as yet extant, accommodation,
making up of suits, may be an advantage.
Ruin will be certain and on to both parties:
success uncertain to him that is in the right. The
certainty of a part of a man's right without expence
more than equivalent to the whole: partial is less
bad than total injustice. These are inducements
for to accommodation on the Pursuer's side: then too the same
are inducements to accommodation on the Defendant's
side.
Accommodation may be thus produced either
with or without discussion of the merits
Accommodation thus effected is it a good or
a bad thing? It is a bad thing abstractedly and
absolutely speaking. Some man has something more or less of
what is his due: the promises held out by the law are
