Accommodation then in any other case than
the foregoing, is but another name for a partial
denial of justice. It supposes a man to have
been wrought upon by some means or other
to give up a part of that which was his
right: for if nothing is given up, the transactionhe does not it is not accommodation
but executionsubmission. It is not only a denial
of justice; but it is an encouragement given to
selfishness and that the greater the greater the
degree of selfishness. The impartial decision of the
law put, simple with the artful;
the generous up cosy or generous upon
a footing with the selfish. Accommodation disturbs
this equality: it brings upon the carpet a bargain
puts the parties upon driving a bargain in which
and sets on foot a contest in which bold the
most obstinate and and hard-headed and hard-hearted
will naturally bear the prize. the advantage
is on the side of
the encroaching,
the selfish & the
obdurate.
When In accommodation is when held up by the
law as an eligible measure a defendant who
knowns he is in the wrong beholds a flustering resource
